Liability Release
This liability release is applicable to any product or service purchased from or provided by Gardner Performance Diesel (GP Diesel).
The customer, hereby release GP Diesel from any claims for loss, damage, or injury sustained from the purchased product, product installation or use.
GP Diesel does not maintain any liability insurance for protection of individual, business entities, groups, organizations, spectators, or others who may participate in any activity based around the product purchased, product installation or use.
In consideration of the purchase, installation, and use of any product provided by GP Diesel, the agreeing customer, business entity, group, organization, spectator, or other, does hereby release and forever discharge GP Diesel, and its officers, directors, agents, and employees, jointly and severally, from any and all actions, causes of actions, claims, and demands for, upon, or by reason of any damage, loss or injury, of any kind of nature, which may be sustained by purchasing, installing or using any product provide by GP Diesel.
This Liability Release extends, applies to, covers, and includes, all unknown, unforeseen, unanticipated, and unsuspected injuries, damages, losses, and liabilities and the consequences thereof, as well as those now disclosed and known to exist.
The customer hereby agrees, on behalf of his or her heirs, executors, administrators, and assigns, to indemnify Provider and its officers, directors, agents and employees, joint and severally from any and all actions, causes of actions, claims and demands for, upon or by reason of any damage, loss or injury, of any kind or nature which may be sustained by the purchase, installation, and or use of any product offered by GP Diesel.
It is further understood and agreed that any activity around the purchase, installation, and or use of any product offered by GP Diesel is not to be construed as an admission of liability or acceptance or assumption of responsibility by GP Diesel, its officers, directors, agents, and employees, jointly and severally, or any damages and/or expenses for which GP Diesel, its officers, directors, agents, and employees, become liable as a result of any alleged act of the customer.
Offroad Use Only Agreement
Agreeing to this policy you agree to release Gardner Diesel Performance (GP Diesel) from any claims for loss or fines incurred from the use of any product designated or intended for offroad use only. In the action of agreeing to this policy you certify that any product provided by or purchased from GP Diesel, which is designated and intended for offroad or competition use only, will NEVER be installed or used on any vehicle that is registered for use on any form of a public roadway. Additional laws and regulations may be in effect and vary by location. In many locations IT IS ILLEGAL to remove, modify, or debilitate any component(s) or system(s) that may affect vehicle emissions or safety. Check all applicable laws before purchasing and or installing any product provided by or purchased from GP Diesel. You agree that all penalties and fines are the sole responsibility of the end user. It is your responsibility to ensure that your vehicle complies with all federal, state, and local laws and regulations.
Shipping Policy
GP Diesel has the right to change this policy at any time.
Orders are typically processed within 2 business days. Orders are processed Monday thru Friday during normal business hours.
GP Diesel utilizes UPS and the USPS for shipping goods. Shipping transit times are typically 2 - 5 business days within the 48 contiguous U.S. states (excluding Hawaii, Puerto Rico and the U.S. Virgin Islands).
GP Diesel ships goods only within the 50 U.S. states and Canada. GP Diesel does not ship goods outside the 50 U.S. states and Canada; any ordered received GP Diesel has the right to cancel and issue a full refund.
APO/FPO (military address)
UPS does not deliver to APO/FPO addresses. GP Diesel utilizes UPS for shipping services, therefore cannot ship to APO/FPO addresses. Any order received with an APO/FPO address, GP Diesel has the right to cancel and issue a full refund.
International Shipping
International shipments may incur additional expenses such as brokerage fees, duties and import taxes on the shipment. Customs policies vary widely and GP Diesel cannot predict these additional expenses. The customer is fully responsible for all additional expenses incurred; some may be collected at the time of delivery. Shipment delays due to customs, beyond GP Diesel shipping time estimates, are out of GP Diesel's control. It is suggested that customers contact their local customs office for more information (orders to Canada only).
UPS transit times for Canada orders are typically 7 to 15 days.
Free Shipping
Free shipping [when offered] applies only to U.S. addresses located withing the 48 contiguous U.S. states, excludes Hawaii, Alaska, Puerto Rico, and the U.S. Virgin Islands.
Free shipping is ground shipping only, expedited shipping is excluded.
Oversize and freight items are excluded.
Return Policy
If for any reason you are not completely satisfied with your purchase or just change your mind, you may return the item within 30 days of the delivery of your order or *you may cancel your order prior to its shipment. The following rules apply:
- The product must have not been fully installed
- The product must be in new and resalable condition
- The product must be returned in the original packaging in its entirety
- Shipping fees will not be refunded
- *You may not be able to cancel an order if it includes a customized product, such as a custom powder coat color, depending on whether the customization has been started.
Warranty Terms & Conditions
Products or services covered by a warranty are covered for manufacturer defects only. All warranty determinations will be determined solely by GP Diesel. Should a product or feature of a product fail due a manufacturer defect, the customer is entitled to an exact replacement of that specific product or feature.
